1. Purpose
The purpose of these Terms and Conditions of Use (TCU) is to define the terms and conditions of access and use of the
KERT’APP mobile application (hereinafter ‘the Application’). Any use of the Application implies full and complete acceptance of
these TCU.

2. Access to the application
The Application is accessible:
• via download from official platforms (App Store, Google Play)
• via the application’s website
• on compatible smartphones or tablets
The Publisher endeavours to ensure 24/7 access, but cannot guarantee uninterrupted availability.

3. Account creation
Certain features require the creation of a user account.
The user undertakes to:
• provide accurate information
• maintain the confidentiality of their login details
• not impersonate a third party
The user is responsible for all activity carried out via their account.

4. Authorised use
The user undertakes to:
• use the application in accordance with its intended purpose
• not misuse the features
• not attempt to access technical systems fraudulently
• not publish content that is illegal, defamatory, hateful or contrary to the law
Any misuse may result in the suspension or deletion of the account.

5. Intellectual property
All elements comprising the Application (text, logo, design, code, database, images, features) are protected by intellectual
property law. Any reproduction, modification or use without authorisation is prohibited.

6. Personal data
Use of the Application may result in the collection of personal data. The processing of this data is governed by the Privacy Policy
accessible in the Application.
The user has the following rights:
• right of access
• right of rectification
• right of erasure
• right of objection
• right to portability

7. Liability
The Publisher cannot be held liable for:
• temporary service interruptions
• bugs or technical malfunctions
• inappropriate use by the user
• indirect damage related to the use of the Application
Users use the Application under their sole responsibility.

8. Modification of the T&Cs
The Publisher reserves the right to modify these T&Cs at any time. Users will be informed in the event of any substantial
modification. Continued use constitutes acceptance of the new T&Cs.

9. Termination
The Publisher may suspend or delete an account:
• in the event of a breach of the T&Cs
• in the event of fraudulent behaviour
• in the event of interference with the proper functioning of the service
Users may delete their accounts at any time via the application settings or by contacting support.

10. Applicable law
These Terms of Use are subject to French law.
In the event of a dispute, the parties shall seek an amicable solution before taking any legal action. Any legal action shall be taken
in the country of the application, i.e. France.
