GENERAL TERMS AND CONDITIONS OF SALE (GTC)

1. Purpose
The purpose of these General Terms and Conditions of Sale (hereinafter ‘GTC’) is to define the rights and obligations between:
• the user (hereinafter referred to as the ‘User’ or ‘Customer’);
• the publisher of the mobile application (hereinafter referred to as the ‘Publisher’).
They apply to all sales of paid digital services accessible via the KERT’APP mobile application

2. Acceptance of the GTC
By accepting these GTC (e.g. by ticking a box or clicking ‘Accept’ when making a purchase), the User acknowledges:
• that they have read and understood all of the terms;
• that they accept them without reservation;
• that they are of legal age or are acting with the consent of their legal representative.

3. Products and Services
The services offered via the application may include:
• monthly/annual subscriptions;
• purchases of additional features (in-app purchases);
• paid digital content.
Each service is described with its terms and price in the application interface before the User confirms the purchase.

4. Prices
Prices are indicated in euros (€), including all taxes (VAT included).
The Publisher reserves the right to change its prices at any time without notice, but the changes do not apply to purchases already
made.

5. Payment
5.1. Payment methods
Payment is made via integrated payment services (e.g. Apple App Store, Google Play, Stripe, etc.).
The user guarantees the Publisher that they have the necessary authorisations to use the chosen payment method.
5.2. Security
Bank details are encrypted and processed by secure payment providers; the Publisher does not have access to full card details.

6. Subscriptions and Renewal
• Subscriptions are automatically renewed at the end of their term unless cancelled by the User.
• The User may manage or cancel their subscription via their account settings or through the store manager (App Store/Google
Play).

7. Right of withdrawal (consumers)
In accordance with Article L221-18 of the Consumer Code, the User does not have the right of withdrawal for contracts for the
supply of digital content not provided on a physical medium, after downloading or reading it.

8. Delivery of Services
Digital services are considered delivered as soon as they are made available in the application or via a user account, without any
additional waiting time.

9. Responsibilities
The Publisher undertakes to provide the services in accordance with the descriptions displayed in the application.
However:
• the Publisher cannot guarantee permanent and error-free access to the application;
• the Publisher is not liable for any indirect damage related to the use or inability to use the application.

10. Intellectual Property
All elements (text, trademarks, logos, interfaces, etc.) present in the application are protected by intellectual property laws. Any
total or partial reproduction is prohibited without prior authorisation.

11. Personal Data
The use of personal data is governed by the application’s Privacy Policy, which is separate from these T&Cs.
The User agrees that their data may be processed in accordance with this policy.

12. Applicable law and disputes
These T&Cs are governed by French law.
In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing this, the competent court shall be that of
the Publisher’s registered office.
